1. General Information
FireRoofs LLC, FireRoofs.com ("the Company") provides roof and exterior sprinkler installation services for wildfire protection. The information provided by the Company, including but not limited to consultations, recommendations, marketing materials, and website content, is for general informational purposes only. It is not a substitute for professional advice, including legal, engineering, or fire safety consultation, and does not guarantee protection against wildfires or other natural disasters.
2. No Guarantee of Fire Protection
While our roof and exterior sprinkler systems are designed to help mitigate the risk of wildfire damage by reducing ignition potential from wind-blown embers, radiant heat, and direct flame contact, the Company does not guarantee that the installation of such systems will prevent damage to or loss of property, injury, or loss of life during a wildfire. Wildfires are unpredictable, and their behavior can be influenced by factors beyond our control, including but not limited to wind conditions, fire intensity, water supply availability, and the condition of the property.
The effectiveness of exterior sprinkler systems may also depend on proper maintenance, adequate water pressure, timely activation, and compliance with local fire safety codes. The Company is not responsible for the failure of the system due to improper use, lack of maintenance, or external factors such as power outages, water supply interruptions, or extreme weather conditions.
3. Compliance with Laws and Regulations
The Company strives to comply with all applicable federal, state, and local laws, including but not limited to the California Fire Code (Title 24, Part 9), California Building Code, and regulations set forth by the California Department of Housing and Community Development (HCD). However, it is the responsibility of the property owner to ensure that the installation and use of the sprinkler system comply with all relevant laws, ordinances, and homeowner association (HOA) rules. The Company is not liable for any fines, penalties, or legal actions resulting from non-compliance.
4. Installation and Maintenance
The Company will install roof and exterior sprinkler systems according to industry standards and manufacturer specifications. However, the property owner is responsible for regular maintenance, testing, and inspection of the system to ensure its functionality. The Company is not liable for damages or system failures resulting from improper maintenance, tampering, or modifications made by the property owner or third parties.
5. Water Usage and Environmental Impact
Exterior sprinkler systems may require significant water usage, and their activation could impact local water pressure, especially during emergencies when water resources may be limited. The Company is not responsible for any reduction in water pressure, water shortages, or related consequences that may affect firefighting efforts or neighboring properties. Property owners are encouraged to consult with local water authorities and fire departments regarding water usage regulations and potential impacts.
Additionally, the Company is not liable for any environmental damage, including but not limited to erosion, flooding, or damage to landscaping, resulting from the use of the sprinkler system.
6. Insurance and Liability
The installation of a roof and exterior sprinkler system may or may not impact your property insurance coverage or premiums. It is the responsibility of the property owner to consult with their insurance provider to determine any potential benefits or requirements. The Company is not responsible for changes in insurance coverage, denial of claims, or increased premiums related to the installation or use of the system.
The Company's liability is limited to the scope of the services provided and does not extend to consequential, incidental, or indirect damages, including but not limited to property damage, loss of use, or economic loss, unless required by law.
7. Limitations of Liability
To the fullest extent permitted by law, the Company's liability for any claims arising from the installation, use, or performance of the sprinkler system shall be limited to the amount paid by the property owner for the services rendered. The Company is not liable for damages caused by acts of nature, third-party negligence, or failure to follow recommended maintenance and usage guidelines.
8. Third-Party Products and Services
The Company may use third-party products, such as sprinkler heads, valves, or foam fire retardants, controllers in the installation of the system. The Company is not the manufacturer of these products and is not responsible for defects, failures, or damages caused by such products. Any warranties or claims related to third-party products should be directed to the manufacturer.
Additionally, the Company is not affiliated with or responsible for the actions of third-party contractors, fire departments, or other entities involved in wildfire response or property protection.
9. Activation and Evacuation
The Company recommends that property owners evacuate early during a wildfire and follow all directives from local authorities. Exterior sprinkler systems should not be relied upon as a substitute for evacuation or professional firefighting efforts. The Company is not responsible for injuries, loss of life, or property damage resulting from failure to evacuate or improper reliance on the sprinkler system.
10. Home Hardening and Defensible Space
The effectiveness of exterior sprinkler systems is enhanced when combined with other wildfire mitigation measures, such as home hardening (e.g., fire-resistant roofing, ember-resistant vents, gutter guards) and defensible space landscaping. The Company is not responsible for the overall fire safety of the property, and property owners are encouraged to consult with fire safety experts and comply with California wildfire prevention guidelines, such as those provided by CAL FIRE and Fire Safe Marin.
11. Indemnification
The property owner agrees to indemnify and hold harmless the Company, its employees, agents, and subcontractors from any claims, damages, or liabilities arising from the use or misuse of the sprinkler system, except in cases of gross negligence or willful misconduct by the Company.
12. Governing Law
This disclaimer and any disputes arising from the services provided by the Company shall be governed by the laws of the State of California. Any legal actions must be brought in the appropriate courts in [County of System], California.
